Description of Service

Brender Cloud is a cloud-based rendering software that allows users to upload scenes in .blend format for rendering. Our service caters to industries such as animation, video games, architectural visualization, design, and the creation of synthetic data for machine learning.

Access and Registration

Users must create an account to use the service. Access credentials and passwords are securely stored. In case of access loss, users should contact us at brendercloud@gmail.com.

Payments and Pricing

Our service operates on a pay-per-use model, with charges applied at the end of each month based on consumption. There's no need to cancel the service; if not used, no charges apply. If a render fails due to an internal error at Brender Cloud, the corresponding amount will be refunded.

Use Rights and Licenses

Brender Cloud grants users a license to use the software for both personal and commercial purposes. The use of the software for illegal activities, including mining cryptocurrencies, is strictly prohibited. Unauthorized copying, redistribution, or resale of the software is also prohibited.

Intellectual Property

Brender Cloud owns the software. However, scenes uploaded by users for rendering remain their property at all times. Brender Cloud has no right to use these scenes without the explicit permission of the users.

Liability

Brender Cloud is not responsible for damages or losses resulting from the use of the software, except in cases where the error originates from our end. We do not guarantee that the software will be error-free or uninterrupted.

Modifications to the Terms of Service

We reserve the right to modify these Terms of Service in the future. In case of changes, we will notify users via email.

Suspension and Termination of Service

We may suspend or terminate access to the service in cases of misuse, including use of the platform for unauthorized purposes, or non-payment. In case of account cancellation, the user has the right to request the deletion of their data, as provided in our Privacy Policy.

Data and Privacy

The handling of personal data is described in detail in our Privacy Policy. We do not share data with third parties without user consent, except when necessary for the operation of the service. Our privacy practices comply with applicable U.S. federal and state laws, including the California Consumer Privacy Act (CCPA) where applicable.

Dispute Resolution

Any dispute arising in relation to these Terms of Service will be resolved through mandatory arbitration, in accordance with the laws of the State of Delaware. The arbitration will take place in Wilmington, Delaware, and the parties expressly waive any right to litigate in court, except as required to enforce the arbitration award or as required by law.

Our services are not directed to children under the age of 13. Users must be at least 13 years old to create an account and use our services.

We use Stripe for payment processing. By using our service, you acknowledge that your billing information will be processed by Stripe in accordance with their privacy policy.

Users are prohibited from using our service to render or process any illegal, explicit, harmful, or otherwise inappropriate content, including but not limited to content involving the illegal mining of cryptocurrencies. We reserve the right to suspend or terminate accounts that violate this policy.

We retain your personal data only as long as necessary to fulfill the purposes outlined in this Privacy Statement and to comply with legal obligations. Specific retention periods depend on the type of data and the purpose of its collection, in compliance with GDPR regulations. Basic data, such as submitted renders, is deleted on a weekly basis.

If you are accessing our service from outside the United States, you consent to the transfer of your personal data to and processing in the United States, where our servers are located.
